Terms and conditions
By entering this site, you as a user, are
accepting our terms and conditions. The access of and use of The 11+
Website featuring these terms and conditions constitutes your
acceptance of these terms and conditions. They take effect from the date
on which you first use this website.
You agree to use this site only
for lawful purposes, and in a manner that does not infringe the rights
of, or restrict the use and enjoyment of this site by any third party.
By restriction or inhibition, we include, without limitation, any conduct which is unlawful, or which may cause distress to or inconvenience or harass any person, and the transmission of obscene or offensive content, or the disruption of normal flow of dialogue within this site.
1. Definitions:
1.1 "Company" means Bright Young Things trading as The 11+ Website.
1.2 "Terms"
means the terms and conditions.
1.3 "Goods" means any items offered for sale
by the company.
1.4 "Customer" means any company or individual who places an
order with the Company for goods.
1.5. "Contract" means the acceptance by
the Company of an order, place by a customer and such acceptance shall occur
when the Company commences work on an order or when the company agrees to accept
the order and communicates this to the customer.
2. Contracts
2.1 These terms shall apply to every contract.
2.2 The Company may
ask for any information it requires to fulfil the contract and there shall be no
liability upon the Company for non-performance if the necessary information is
not provided.
3. Price
3.1 All prices quoted by the Company are
only valid at the time of contract and are exclusive of any other matters unless
otherwise agreed.
3.2 The Company reserves the right to revise the quoted
price in the event of unforeseen and extraordinary expenses for the Company
appertaining the goods.
4. Payment
4 Goods will only be
dispatched to the customer when payment has been made in full in cleared funds
and in any variance of this term shall be upon such terms as the Company
dictates.
5. Samples
5.1 Should the Company present a customer
with a sample, this will not constitute a sale by sample and is only and
indication of the type and quality of the goods.
6 Delivery
6.1 Delivery shall be made to the customer and not a third
party.
6.2 The company will not accept any liability for late delivery of
the goods and delivery time will not be of the essence of the contract.
6.3.
The Company will not accept liability for non-delivery, where this is caused by
circumstances beyond its control.
6.4 All risks shall pass to the consumer
upon delivery
6.5 Postage and packing are free to UK customers. For orders
outside the UK, a post and packing charge will be made. Please conact us before
making your order.
6.6 We aim to dispatch all UK orders within 48 hours of
recieving your order. Please note that during holiday periods and at weekends,
this time period may be longer.
6.7 Customers should receive their order
within seven days of dispatch. If not please contact us so we can check with our
couriers about a delay.
7 Refunds.
7.1 If you are not satisifed with your postal purchase for
any reason, we offer a full refund, provided the item is unused and in
perfect condition within 14 days of purchase. Please contact us first
by telephone or e-mail to let us know, before you return your purchase(s). We
regret that we cannot pay for return postage to us.
7.2 We do not
give refunds for downloaded material from our website. See section on
downloads below for more information.
8 Warranty
8.1 The Company warrants that the goods will be free
from defects at the time of dispatch.
8.2 The customer must notify the
Company of any defects within 5 working days of delivery and the Company must be
given a reasonable opportunity to view the goods.
9 Force Majure
9.1
The Company shall not be liable to the customer in the event that the Company is
unable to carry out any part of the contract for causes beyond its control.
9.2 The Company will notify the customer as soon as is reasonably possible
in such circumstances.
10 General
The laws of England and Wales will
govern any contract.
11 Special terms and conditions for downloads:-
1) You agree that the material you download from the 11+ Website shop is for your sole use (or that of any member of your family) and will not be passed onto any third party, copied in any way or resold. (Please note - Schools, individual teachers and tutors may use this service provided that they do not copy individual downloads which are the intellectual property of Bright Young Things)
2) The downloadable material you have purchased will be available for you to download for a maximum period of 48 hours, once your payment has been accepted and processed by Pay Pal, our merchant bank. As soon as payment has been made and accepted, you will receive an e-mail with (a) link(s) to the download titles you have decided to buy from us. If you press the link you will get to the pdf file which the download is on. You will need Adobe Reader installed on your computer to read the file with. Links to this software are shown on the website at the top of each page of the shop.
3) The downloads that you buy should be received in an e-mail from us to you within 15 minutes of you paying for your order. Please be aware that sometimes your internet provider may stop e-mails from us to you if it has a virus checker or spam filter in place. If there is a problem with the transmission of your download(s), please contact Bright Young Things either by telephone or e-mail (as mentioned on the first page of the Shop) as soon as possible after ordering and we will endeavour to sort out the problem. If necessary we will send your downloads manually by e-mail.
4) Once you have made your choice and paid for any of the downloads, we cannot give refunds, even if you decide that you have chosen the wrong title. This is due to the nature of electronic publications and is in line with curent consumer law and practice. This is a binding contract and cannot be reversed. So please make sure that you are clear about which downloads you are buying. Please be aware of the difference between the standard format and multiple choice format 11+ Practice test questions. Please note that the questions in both formats are mainly the same.

information within such locations on The 11+ Website. These terms and
conditions shall be governed by and construed in accordance with the
laws of England and Wales. Any dispute arising under these terms and
conditions shall be subject to the exclusive jurisdiction of the courts
of England and Wales.
